TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of pookietech.com.ng and all associated products and services provided by PookieTech. By accessing our website or purchasing our products, you agree to these Terms. If you do not agree, do not use our services.

1. Acceptance of Terms

By using this website you confirm that you are at least 18 years old and legally capable of entering into a binding agreement. If you are using our services on behalf of a business, you confirm you have authority to bind that business to these Terms.

2. Our Products & Services

PookieTech provides:

• Website Templates — pre-built HTML, CSS, PHP, and React templates available for purchase or free download
• Custom Development — bespoke web development services scoped and quoted on a per-project basis
• Tech Blog — free educational content about web development, architecture, and tooling

We reserve the right to modify, suspend, or discontinue any product or service at any time without notice.

3. Template License

When you purchase or download a template from PookieTech, you receive a non-exclusive, non-transferable, single-project license to use the template. This means:

You CAN:

• Use the template for one commercial or personal project
• Modify the code to suit your needs
• Use the template on a client project (counts as one project)

You CANNOT:

• Resell or redistribute the template as a standalone product
• Use the template on more than one project without purchasing additional licenses
• Claim the template as your own original work
• Sub-license, rent, or lease the template to third parties
• Upload the template to any marketplace (ThemeForest, Creative Market, etc.)

4. Purchases & Payment

All payments are processed securely by Paystack. PookieTech does not store your card details. Prices are listed in Nigerian Naira (₦). By completing a purchase you agree to:

• Provide accurate billing information
• Pay the full listed price for the product
• Receive digital download access via the email address you provide

Downloads are delivered immediately after successful payment verification. If your download link does not arrive within 1 hour, contact us with your payment reference.

5. Refund Policy

Because our products are digital downloads, all sales are final once a download has been issued. We do not offer refunds for:

• Products you have already downloaded
• Change of mind after purchase
• Incompatibility with your specific hosting environment

6. Custom Development Work

Custom projects are governed by a separate project agreement or statement of work (SOW) provided before work begins. In the absence of a separate agreement, these Terms apply with the following additions:

• Payment schedule — typically 50% upfront, 50% on delivery unless agreed otherwise
• Ownership — you own the final deliverables once full payment is received. We retain the right to display the work in our portfolio unless you request otherwise in writing
• Revisions — included revisions will be specified in the project scope. Work outside scope will be quoted separately
• Cancellation — if you cancel a project after work has started, you owe for work completed to date based on an agreed hourly rate

7. Prohibited Use

You agree not to use our website or products to:

• Build illegal, fraudulent, or harmful websites or applications
• Distribute malware, spam, or phishing content
• Infringe the intellectual property rights of others
• Scrape or harvest data from our website using automated tools
• Attempt to gain unauthorized access to our systems or databases
• Violate any applicable Nigerian or international law

We reserve the right to terminate your access and take legal action for violations of this section.

8. Intellectual Property

All original content on pookietech.com.ng — including but not limited to blog posts, template code (beyond your licensed use), design assets, and the PookieTech name and logo — is the exclusive property of PookieTech and is protected by Nigerian and international copyright law.

You may not copy, reproduce, or distribute our content without explicit written permission.

9. Disclaimer of Warranties

Our products and services are provided "as is" without warranties of any kind, express or implied. We do not warrant that:

• Templates will be compatible with every browser, server, or third-party tool
• The website will be error-free or available 100% of the time
• Any specific business outcome will result from using our templates

10. Limitation of Liability

To the maximum extent permitted by law, PookieTech shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or services. Our total liability for any claim arising from a purchase shall not exceed the amount you paid for that product.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of Nigeria. If you are based outside Nigeria, you agree to submit to Nigerian jurisdiction for matters arising from these Terms.
